Registration of Divorce

Iranians who wish to register their divorce in their Shenasnameh may present the following documents:

Required Documents:

  1. First of all, one of the two parties should register on Mikhak (https://mikhak.mfa.gov.ir) and fill the "divorce registration request" and receive the tracking code. After that, submit the following documents along with the received tracking code printout to the consular section. It is sufficient to register the request in the mikhak site by one of the two parties.
  2. Presenting the original shenasnameh and national ID card of the couple
  3. Submission of the original sharia divorce certificate issued by Islamic centres and institutions approved by the Consulate General of the Islamic Republic of Iran (to see the names, refer to the bottom of this page.)
  4. Submission of the original divorce certificate issued by the court, which has been approved by the Maharashtra government (Mantralaya)
  5. Residence permit such as visa, OCI
  6. Presentation of the original marriage certificate of the couple

Note: The registration of revocable divorce (Reje'i) will be due after three months and ten days (Iddah period) from the date of issuance of the Sharia divorce and verification that the revocability clause has not been acted upon. (Rojou).

Note:

In the following cases, the divorce request must be pursued through Iran's courts (in person or by appointing a lawyer):

            A- The spouses have not reached a conclusion regarding the official registration of divorce in the consulate general or lack the required documents for the official registration of divorce.

           B- One of the spouses doesn’t want to register the divorce or is not present in India, or the divorce order of the Indian court was issued unilaterally (at the request of one of the spouses)

Therefore, based on the current regulations in this regard, the representative of the Islamic Republic of Iran is not able to register the divorce.
